Grounds for refusing registration of a designation reproducing a well-known mark, beyond Article 15 of Law of the RK No. 456-I, include Articles 6bis and 10bis of the Paris Convention for the Protection of Industrial Property.

⚠ Examination may refuse registration of a designation identical or similar to a well-known mark in the name of a third party for any type of goods and/or services — not only those homogeneous with those for which the mark is recognised as well-known — if this could be regarded as unfair exploitation of its reputation.

6. The Madrid System: International Registration Through Kazakhstan

The Madrid System allows an applicant from Kazakhstan to file a single international application through NIIP and obtain trademark protection in several selected contracting parties without filing separate national applications in each.

The Republic of Kazakhstan acceded to the Madrid Protocol (the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks, 1989) on 8 September 2010; the Protocol entered into force for Kazakhstan on 8 December 2010.
